Background:

The Audiovisual Media Services Directive (AVMSD) creates an EU-level framework to coordinate national legislation on all audiovisual media, both traditional TV broadcasts and on-demand services (for example, Netflix, Amazon Video, Now TV).

It sets out requirements on aspects such as prohibition of hateful and discriminatory speech based on disability and other grounds, protection of minors, independence of national regulatory bodies, and the promotion of European audiovisual productions.

The revised AVMSD, was adopted in November 2018, and contains stronger provisions on accessibility of audiovisual media content, and the prevention of discrimination on the ground of disability in audiovisual services. EU countries must transpose the Directive into national law by 19 September 2020. They now have the unique opportunity to further advance audiovisual media accessibility and consumer protection against discrimination and hate speech. Now is therefore also the time for disability advocates to act to ensure strong national laws.
